The Delhi High Court said, the POCSO Act ensures that children are not sexually exploited and harassed. The court also rejected the claim that a minor Muslim girl who had attained the age of puberty would be out of the purview of POCSO. Justice Jasmeet Singh of the Delhi High Court said, the Protection of Children from Sexual Offenses Act (POCSO Act) provides protection to all children below the age of 18 years.
This customary law is not specific. The court’s remarks came during the hearing of a petition seeking quashing of the chargesheet filed under the Dowry Protection Act and FIR registered under the POCSO Act, including rape, criminal intimidation.

The petitioner contended that since the victim Muslim girl was 16 years and 5 months of age on the day of the alleged accident, she was an adult under the Muslim Personal Act. Therefore, POCSO law does not apply to him. But the court rejected these arguments and dismissed the petition.
